BY BIDDING ON THIS AUCTION, BUYER AGREES TO ALL TERMS AND CONDITIONS SET FORTH AND ENTERS INTO A CONTRACTUAL AGREEMENT TO PURCHASE THE ITEM(S) UNDER THE FOLLOWING TERMS AND CONDITIONS: 
 
CATALOG: Aumann Auctions has put forth every effort in preparing the catalog for this auction to provide accurate descriptions of all items. 
AS-IS: All lots are sold AS-IS, WHERE-IS, with all faults, imperfections and errors of description. Due diligence is the responsibility of the bidder/buyer. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. 
BUYER'S PREMUM: A 10% Buyers Premium will be added to the winning bid to determine the purchase price of each item. 
PAYMENTS: All sales are final. All accounts must be settled at the conclusion of the auction. We accept Cash, Checks, Wire Transfer With Deposit, Visa & MasterCard ONLY. If paying by credit card, your credit card will be charged for the winning bid amount, plus the Buyers Premium, plus a 5% Credit Card Fee. Note: Each transaction necessary to collect insufficient funds will be considered in Default of Buyer's contractual obligations. See below.

DEFAULT OF BUYER: Successful bidder not paying for items at the end of the auction will be considered in default. Such default by the Successful Bidder will result in that Bidders liability to both the Seller and Aumann Auctions, Inc. Seller shall have the right to resell the items either publicly or privately with Aumann Auctions, Inc. and in such an event, the Buyer shall be liable for payment of any deficiency realized from the second sale plus all costs, including, but not limited to the holding/transporting/storage costs of the items, the expenses of both sales, legal and incidental damages of both the Seller and Aumann Auctions, Inc. In addition, Aumann Auctions, Inc. also reserves the right to recover any damages separately from the breach of the Buyer. The purchaser agrees to pay all reasonable attorney fees and costs incurred by Aumann Auctions, Inc. in the debt collection or dispute proceedings. The purchaser also agrees that a storage/handling fee and 2% per month interest on the unpaid balance will be added to any amount due the Seller and Aumann Auctions, Inc. and any other costs or losses incurred by the Buyers failure to adhere to these terms. 
Both the Successful Bidder and Seller shall indemnify Aumann Auctions, Inc. for and hold harmless Aumann Auctions, Inc. from any costs, losses, liabilities, or expenses, including attorney fees resulting from Aumann Auctions, Inc. being named as a party to any legal action resulting from either Bidders or Sellers failure to fulfill any obligations and undertakings as set forth in this contractual agreement. 
 
CONDUCT OF THE AUCTION: Conduct of the auction and increments of bidding are at the direction and discretion of Aumann Auctions, Inc. Aumann Auctions, Inc. reserves the right to reject any and all bids for any reason and also reserves the right to cancel this auction, or remove any item or lot from this auction prior to the close of bidding. All decisions of Aumann Auctions are final. 
Your bid on this auction indicates both an understanding and an acceptance of the terms of this contractual agreement between yourself and both Aumann Auctions, Inc. and the Seller and that you, as the Bidder, are prepared to purchase items under these terms and conditions.

DURCH DIE TEILNAHME AN DIESER AUKTION ERKLÄRT SICH DER KÄUFER MIT ALLEN FESTGELEGTEN BESTIMMUNGEN UND BEDINGUNGEN EINVERSTANDEN UND SCHLIESST EINE VERTRAGLICHE VEREINBARUNG ZUM KAUF DES AUKTIONSGEGENSTANDES/DER AUKTIONSGEGENSTÄNDE ZU FOLGENDEN BESTIMMUNGEN UND BEDINGUNGEN AB: 
Aumann Auctions hat sich nach Kräften bemüht, den Katalog für diese Auktion zu erstellen und eine korrekte Beschreibung aller Gegenstände zu liefern. 
Alle Lose werden verkauft „WIE BESEHEN“, mit allen Fehlern, Mängeln und Beschreibungsfehlern. Die ordnungsgemäße Sorgfalt, Inspektion und Bestimmung des Zustands liegt allein in der Verantwortung des Bieters/Käufers. Gedruckte Erklärungen oder Beschreibungen der Mitarbeiter werden nach Treu und Glauben abgegeben und sind reine Ermessenssache. 
KÄUFERPRÄMIE: Dem Zuschlag wird eine Käuferprämie von 10 % hinzugerechnet, um den Kaufpreis für jeden Gegenstand zu bestimmen. 
ZAHLUNGEN: Alle Verkäufe sind endgültig. Alle Konten müssen am Ende der Auktion ausgeglichen sein. Wir akzeptieren AUSSCHLIESSLICH Bargeld, Schecks, Überweisung mit Hinterlegung, Visa & MasterCard. Bei der Bezahlung mit Kreditkarte wird Ihre Kreditkarte mit der Höhe des Zuschlags zuzüglich der Käuferprämie, zuzüglich einer Kreditkartengebühr von 5 % belastet. Bei der Bezahlung per Überweisung ist ein zusätzlicher Vertrag erforderlich. Sollte eine Maßnahme zur Beitreibung der Gelder erforderlich sein, so wird der Käufer mit seiner vertraglichen Verpflichtung in Verzug gesetzt und kann – wie nachstehend angegeben – weiteren Gebühren unterworfen sein. 
VERZUG DES KÄUFERS: Ein erfolgreicher Bieter, der am Ende der Auktion die Gegenstände nicht bezahlt oder keine akzeptablen Vorkehrungen mit der Auktionsgesellschaft trifft, gilt als in Verzug geraten. Ein solcher Verzug des erfolgreichen Bieters führt zu einer Haftung dieses Bieters sowohl gegenüber dem Verkäufer als auch gegenüber Aumann Auctions, Inc. Der Verkäufer ist berechtigt, die Gegenstände mit Aumann Auctions, Inc. entweder öffentlich oder privat weiterzuverkaufen. In diesem Fall vereinbart der Käufer, dass er für die Bezahlung von Fehlbeträgen aus dem zweiten Verkauf zuzüglich aller Kosten, einschließlich, jedoch nicht beschränkt auf die Halte-/Transport-/Lagerkosten der Gegenstände, die Kosten für beide Verkäufe, gesetzliche und Nebenforderungen des Verkäufers und von Aumann Auctions, Inc. haftet. Darüber hinaus behält sich Aumann Auctions, Inc. das Recht vor, gesondert Schadenersatz aufgrund der Vertragsverletzung des Käufers geltend zu machen. Der Käufer vereinbart auch, alle angemessenen Anwaltskosten und Kosten, die Aumann Auctions, Inc. bei der Beitreibung der Schulden oder bei den streitigen Verfahren entstanden sind, zu bezahlen. Der Käufer erklärt sich auch einverstanden, dass eine Lager-/Bearbeitungsgebühr und Zinsen von 2 % pro Monat auf den unbezahlten Betrag und etwaige andere Kosten oder Verluste, die durch das Versäumnis des Käufers, diese Bestimmungen zu befolgen, zu dem an den Verkäufer und/oder Aumann Auctions, Inc. zahlbaren Betrag addiert werden. 
Sowohl der Käufer als auch der Verkäufer entschädigen und halten Aumann Auctions, Inc. schadlos aus Kosten, Verlusten, Verbindlichkeiten oder Ausgaben, einschließlich Anwaltskosten, die daraus entstehen, dass Aumann Auctions, Inc. als Partei in einem Rechtsverfahren genannt wird, das sich aus dem Versäumnis des Bieters oder des Verkäufers bei der Erfüllung von Pflichten und Zusagen, die in dieser vertraglichen Vereinbarung festgelegt sind, ergibt. 
DURCHFÜHRUNG DER AUKTION: Die Durchführung der Auktion und die Steigerungssätze erfolgen nach Anweisung und im Ermessen von Aumann Auctions, Inc. Aumann Auctions, Inc. behält sich das Recht vor, jegliche Gebote aus einem beliebigen Grund abzulehnen, und behält sich außerdem das Recht vor, diese Auktion zu stornieren oder vor dem Ende der Gebotsphase einen Gegenstand oder ein Los aus der Auktion zu nehmen. Alle Entscheidungen von Aumann Auctions sind endgültig.
